Terms & Conditions
1. Scope of Application
1.1 The following General Terms and Conditions shall apply to all legal transactions of the Career Coach under this Agreement with its contractual partner, hereinafter referred to as “Candidate”.
1.2 The Candidate shall be notified in writing of any amendments to these Terms and Conditions. They shall be deemed to have been approved if the Candidate does not raise an objection in text form. The Candidate must send the objection to the Career Coach within two weeks after notification of the changes.
2. Subject Matter of the Contract
2.1 The Career Coach offers online and offline coaching sessions and seminars. These can be attended by the Candidate (online). A precise description and listing of the range of services shall be announced by the Career Coach, among other places, in its business premises, its Internet presence and other media used by the Career Coach.
2.2 Basic subject of the contract/task description:
1. The Career Coach will provide one-to-one and/or group coaching services based on the chosen coaching plan of the Candidate. Active Candidate participation is required and the Career Coach is not providing any done-for you services.
3. Conclusion of the contract
3.1 A contract with the Career Coach is concluded by the transmission and confirmation of the completed and signed declaration of participation by mail, fax, electronic mail or by verbal agreement and subsequent submission of a written declaration of participation.
3.2 Each Candidate shall receive a letter of confirmation or rejection upon receipt of his/her declaration of participation.
3.3 The declaration of participation is binding and can only be declared invalid after consultation with the Career Coach.
3.4 In the case of a group registration, for example in the case of a company outing, the Career Coach concludes a participation agreement with the person responsible for the Candidates or with the person authorized to give instructions about and for the group. This is also binding.
3.5 The Career Coach reserves the right to cancel or terminate the session up to 4 weeks before the start of the session after exhausting all possibilities, if this is not reasonable because the booking volume for this session is so low that the costs incurred in relation to this session would mean exceeding the economic sacrifice limit.
3.6 However, the Career Coach shall only have the right to withdraw from the session if it can prove the circumstances leading to the withdrawal and has made the Candidate a comparable alternative offer. The paid participation fee will be refunded immediately.
3.7 In addition, the Career Coach shall reimburse the Candidate’s booking expenses as a lump sum if the Candidate does not make use of the substitute offer.
4. Duration of the contract and remuneration
4.1 The contract begins and ends on the specific and individually agreed date.
4.2 Payment modalities: The participation fee for the respective session is based on the current price table of the Career Coach at the time of the conclusion of the contract.

to meet his/her payment obligation.
Special terms of payment:
4.3 All payments are due in advance to the start of the program without any deductions.
4.4 Cash expenses and special costs incurred by the Career Coach at the express request of the Candidate will be charged by separate agreement.
4.5 All services of the Career Coach are inclusive of the legally valid tax.
5. Scope of services and services not utilized
5.1 The scope of services is based on the respective contract between the Career Coach and the Candidate.
5.2 If individual services are not utilized by a Candidate, the Career Coach reserves the right to invoice the entire participation fee nevertheless. This does not apply if the Candidate can prove that no or only minor damage was incurred. In case of illness or force majeure, the Career Coach will not charge the agreed service.
6. General conditions of participation
6.1 The Candidate is in breach of contract if, despite a warning, he/she persistently disrupts the session, or if he/she behaves in a manner that is significantly contrary to good morals, so that a smooth running of the session cannot be guaranteed. In this case, the Career Coach reserves the right to exclude the Candidate from the session. The Career Coach reserves the right to charge the participation fee. The Candidate is at liberty to provide evidence of lower expenses.
6.2 The seminar leader/coach/trainer is authorized to give instructions to the Candidates for the duration and within the scope of the session.
6.3 Each Candidate shall separately sign a release from liability regarding personal injury and property damage due to participation in the seminar/coaching/training.
6.4 Candidates undertake not to be under the influence of alcohol or other narcotics that may impair their ability to react and their physical well-being. In the session of violations of this, the Career Coach is entitled to exclude the Candidate from the session.
6.5 Prior to the session, the trainer/coach/seminar leader of the Career Coach must be informed about health problems and any illnesses, so that the respective Candidate can be protected from harm in the best possible way.
6.6 In case of recognizable health problems, the Career Coach is entitled to exclude the Candidate in question from the session. The Career Coach reserves the right to charge the participation fee proportionally. The Candidate is at liberty to provide evidence of a lesser expense.
6.7 Sessions and seminars, especially those in the so-called outdoor area are never without a residual risk. Against an accident and rescue each Candidate is insured only in the context of his own accident insurance.
6.8 The candidate is receiving space in the sessions/seminars, support and guidance, but is not guaranteed results from participating in the sessions/seminars.
7. Duty of Confidentiality
The Career Coach is obligated to maintain secrecy about all personal, company and business secrets of the Candidate/client during the duration of a session and also after its conclusion.
8. Liability
8.1 The Career Coach is liable in cases of intent or gross negligence according to the legal regulations. The liability for guarantees is independent of fault. In cases of slight negligence, the Career Coach shall be liable exclusively in accordance with the provisions of the Product Liability Act, for injury to life, limb or health, or for breach of essential contractual obligations. However, the claim for damages for the slightly negligent breach of essential contractual obligations shall be limited to the foreseeable damage typical for the contract, unless there is liability for injury to life, limb or health. The Career Coach shall be liable to the same extent for the fault of vicarious agents and representatives.
8.2 The provision of the preceding paragraph (8.1) extends to damages in addition to performance, damages in lieu of performance and claims for compensation due to futile expenses, regardless of the legal basis, including liability due to defects, delay or impossibility.
